MakerMint Magic provides AI-powered tools for creating digital products. By using this platform, you agree not to misuse the service, attempt unauthorized access, or generate harmful content. All generated content is provided “as-is” and may require your review before publishing. You are responsible for ensuring your products comply with marketplace rules (Etsy, Shopify, etc.). MakerMint Magic may update features or policies at any time.

This page summarizes the agreement between you and MakerMint. It is not legal advice.

1. Who you're contracting with

These Terms are a binding agreement between you and Steven Badaczewski, trading as MakerMint Magic ("MakerMint", "we", "us", "our"). By creating an account or using the service, you confirm you have authority to enter this agreement and are of legal age in your jurisdiction.

2. Acceptance

By continued use of the MakerMint Magic website, apps, AI tools, or related services (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

3. The Service

MakerMint Magic provides AI-powered product description generation, image tools, workflow and inventory utilities, and related software for makers and small ecommerce sellers, on the plan you select.

Across our two brands we offer:

  • AI-generated digital products and software — MakerMint Magic on digitalfoundrylabs.digital. Digital-only; no physical item is shipped.
  • Digital files — SVG, PNG, STL, and PDF downloads, governed by our Digital Download License.
  • Physical handmade products — sold through the K&S Crafts N Things storefront. Handmade items may vary slightly in color, size, or finish. See our Shipping Policy and Refund Policy.

4. Acceptable use & prohibited conduct

You must not:

  • Use the Service unlawfully, fraudulently, or for spam.
  • Infringe any intellectual property or privacy rights.
  • Upload malware or interfere with the Service's security (probing, scanning, scraping).
  • Reverse engineer, resell, or redistribute the Service.
  • Circumvent rate limits, plan limits, or technical controls.

5. AI-specific terms

  • Prohibited content: no illegal content, CSAM, deepfakes of real people without consent, hate speech, harassment, malware, or jailbreak attempts.
  • Your responsibility: you are responsible for your prompts, how you use outputs, verifying accuracy, and ensuring you have rights to any content you upload.
  • IP in inputs/outputs: you retain rights in content you upload; you receive a license to use outputs for your business. Rights holders may submit takedown notices at support@makermint.app; repeated infringement leads to account termination.
  • Moderation: we may remove, restrict, or refuse outputs and suspend accounts that violate these terms.
  • Accuracy disclaimer: AI outputs may be inaccurate or biased. They are not professional advice (legal, medical, financial, regulatory) and should be reviewed before commercial use.

6. Account & credentials

You must keep your login credentials confidential and provide accurate, up-to-date information. You are responsible for activity under your account.

7. Intellectual property

MakerMint retains all rights, title, and interest in the Service, including software, documentation, and branding. Designs, digital files, and content are owned by K&S Crafts N Things or Digital Foundry Labs. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

You may not:

  • Resell our digital files as-is.
  • Claim our designs as your own.
  • Redistribute, share, or re-upload files without permission.

8. User content

You grant MakerMint a limited license to host and process content you upload solely to provide the Service to you.

9. Payments, billing & refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, and cancellation mechanics are governed by Paddle's Checkout / Buyer Terms. See our Refund Policy.

10. Suspension & termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, you may export your data for 30 days; afterwards it may be deleted.

11. Service level & warranties

The Service is provided "as is" with no guarantee of uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid to us in the 12 months prior to the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing limits liability for fraud, death, or personal injury where the law forbids exclusion.

13. Indemnity

You will indemnify MakerMint for claims arising from your content, your unlawful use, or your breach of these Terms.

14. Changes

We may update these Terms as the Service evolves. Material changes will be announced in-app or by email.

15. Governing law

These Terms are governed by the laws of the seller's jurisdiction. Disputes are subject to the exclusive jurisdiction of the courts in that jurisdiction.

16. Force majeure & assignment

Neither party is liable for delays caused by events beyond reasonable control. You may not assign these Terms without our consent; we may assign in connection with a merger or acquisition.

Our order process for digital software and downloadable files is conducted by our online reseller Paddle.com, the Merchant of Record for those orders. Handmade physical goods from K&S Crafts N Things ship from Georgia and require a delivery address.
